Terms of Service (AGB)

1. Scope and Subject Matter
These Terms of Service govern the provision of IT engineering, AI system development, cybersecurity auditing (VAPT), and the use of free analytical web tools provided by cyberEiche (Sudhanshu Kumar Singh, Einzelunternehmen). They apply exclusively to commercial clients, corporations, and public entities (B2B).
2. Service Execution & Cooperation
cyberEiche develops bespoke software architectures, AI pipelines, and conducts penetration tests according to individual service specifications (Statements of Work). The client ensures timely provision of necessary access permissions, documentation, and technical prerequisites.
3. Free Assessment Tools & Security Scanners
Free browser-based assessments (Potential Analysis, ROI Calculator, Compliance Check, Security Quick-Check, VibeSec Scanner) are provided without warranty. They perform passive, non-intrusive surface checks for initial guidance and do not replace comprehensive certification or legal counsel.
4. Data Protection & Confidentiality
Both parties treat all confidential operational and technical information with strict secrecy. Personal data processing complies with Article 28 GDPR (Data Processing Agreement). AI inference operates on sovereign European infrastructure with zero data retention.
5. Intellectual Property & Rights of Use
Upon full remuneration, the client receives the agreed rights of use for custom software components, configurations, and audit reports. Standard libraries, open-source dependencies, and reusable framework modules remain governed by their respective licenses.
6. Liability & Applicable Law
Liability is governed by German statutory regulations. The contractual relationship is subject exclusively to the laws of the Federal Republic of Germany. Place of jurisdiction is Aachen, Germany.
